Riverside Domestic Violence Lawyer Ty Martinez Gets Felony Domestic Violence Case Dismissed

10/25/13 - Riverside Court - Felony kidnapping and felony domestic violence dismissed for a plea to misdemeanor false imprisonment.  DA originally wanted one year of county jail.  Resolved for time served (two days).

Riverside Criminal Defense Attorney Ty Martinez gets Drug Sales Case Dismissed

9/27/13  - Riverside Court - Drug sales case dismissed.  Filed motion to suppress evidence due to an illegal arrest of my client.  Client was pulled over for window tint, taken out of car, placed in back of police car while car searched.  Although it is ok to temporarily detain a person for a traffic violation, and it is ok to take a person out of their car, placing them in the back of a patrol unit escalated the legitimate detention into an illegal arrest.  DA dismissed on their own motion after we filed ours.

9/26/13 - Rancho Cucamonga Court - Marijuana sales case dismissed.  Client was delivering for dispensary.  Went over marijuana cooperative laws with DA. DA dismissed as client was young, and just doing his job, no intent to illegally distribute.

 

9/20/13 - Rancho Cucamonga Court - Domestic Violence case dismissed.  Filed a motion to dismiss based on the DA's violating my client's right to a speedy trial.  DA had no justification for delay.  Court agreed dismissed case.

9/23/13 - Downey Court - DUI dismissed.  Convinced DA of rising blood alcohol level which would have put client under limit.  No bad driving involved.

Rancho Cucamonga Criminal Defense Attorney Ty Martinez gets Three Felony Sales of Meth Charges Dismissed

8/28/13 - Rancho Cucamonga - Three felony counts of sales of a controlled substance (HS 11378) dismissed.  Demonstrated to DA that when officer contacted my client he went through phone and found no incriminating messages and officer gave phone back.  The officer would not have done so if he believed it was a true sales case.  Also, officer referenced "baggies" in the hotel room in report to support sales charge.  I made it clear that the baggies referenced in report were completely different than the baggies found on my client.  The DA agreed and dismissed sales case for a plea to personal use, time served, and a drug program.  Original offer was 16 months state prison.

6/24/13 - Riverside Court- PC 273.5 Domestic Violence case dismissed.  Demonstrated to DA that officers got it wrong and my client was the victim in the alleged offense.

Los Angeles Criminal Defense Attorney Gets Check Fraud Case Dismissed

6/12/13 - LAX Court - DUI refusal case dismissed.  We called ready for trial, DA folded and dismissed DUI charges.

6/11/13 - Long Beach Court - Four felony charges dismissed - 2 counts of 2nd degree burglary and 2 counts of check fraud.  Case involved complex issues regarding bank takeover and confusion with client's documents which got the case dismissed last year.  DA refiled charges and this time the court granted to dismiss as the government violated my client's speedy trial rights.

May 7, 2013 - Los Angeles DMV Hearing involving refusing to take a chemical test.  Suspension set aside.

April 25, 2013 - Rancho Cucamonga Domestic Violence Case Dismissed.

April 24, 2013 - Riverside Misdemeanor Domestic Violence Case Dismissed.

April 24, 2013 - Riverside Felony Domestic Violence Case Reduced. DA originally wanted Felony and 180 days. Case settled for misdemeanor and 15 days of work release.

April 24, 2013 - Riverside Misdemeanor Domestic Case Dismissed. Case was resolved for a PC 415 - disturbing the peace infraction, $100.00 fine, and will not appear on client's record.

April 16, 2013 - Rancho Cucamonga Felony Elder Abuse Case Dismissed.

Santa Ana Court - Felony Strike Case (Attempted Robbery)gets reduced to straight felony (Grand Theft Person).  Previous offer to client and client's former attorney was accept strike offense and 6 months of jail.  Our office got offer reduced to non strike felony, which could be converted to a misdemeanor one year from day of sentence if no new offenses, and 20 days of work program.
