Riverside Domestic Violence Attorney Ty Martinez Gets Not Guilty Verdict for Client

Riverside County South West Justice Center (Murrieta Court) - January 5, 2016 jury returned NOT GUILTY verdict on felony domestic violence case (PC 273.5).  Demonstrated client's ex girlfriend was upset about the breakup, and she was caught lying multiple times when being cross examined by my partner Yvonne Todd.  Jury didn't believe her story and the NOT GUILTY verdict was entered.  Great job Yvonne Todd!


Other notable recent cases:

San Bernardino Court - 1/7/16 Felony Grand Theft (PC 487) - dismissed by DA due to having my client pay restitution to victim up front.

Rancho Cucamonga Court - 1/14/16 - Misdemeanor DUI and Hit and Run (VC 23152a and VC 2002) dismissed outright.  We provided proof to DA that damage to victim's car was paid for by insurance.  Client's alcohol level and drug levels were low enough for our office to get the case dismissed.

Rancho Cucamonga Court - 1/14/16 - Misdemeanor drunk in public (PC 647f) dismissed.  Provided copy of client's successful completion of a program, DA dismissed.

Criminal Defense Attorney Ty Martinez Gets Results

Below are some of our results for 2015:


Riverside Court  1/16/15 - Misdemeanor domestic violence dismissed due to our getting the audio from the police unit that took victim to the station.  Victim was extremely intoxicated, which we presented to DA. 

Rancho Cucamonga Court 3/13/15 - Misdemeanor battery dismissed due to our providing DA with client's office internal investigation report showing that our client was not at fault.

Rancho Cucamonga Court 4/16/15 - Misdemeanor drug possession dismissed.

Rancho Cucamonga Court- 4/23/15 - Felony domestic violence case reduced to a misdemeanor, no jail, fine and 52 week program vs. a felony and 1 year of county jail.

Pomona Court - 5/22/15 - Misdemeanor domestic violence dismissed.  We showed DA that our client called 911 and was the victim in the case.

Rancho Cucamonga Court-  6/17/15 - Felony domestic violence dismissed.  Were able to again show that our client was not the aggressor.

El Monte Court 6/19/15 - 2nd degree burglary and theft case dismissed.  Presented DA with evidence that our client was with a former employee and was unaware of what was actually occurring.

West Covina - 6/24/15 - Not Guilty Verdict on all four counts - Misdemeanor domestic violence; misdemeanor assault with a deadly weapon (vehicle); 2 counts of child endangerment.  Presented jury with evidence of prior domestic violence by "victim" against my client, as a result the law gave my client permission to use reasonable force to defend himself and his children.  Jury agreed.  Not guilty.

Rancho Cucamonga Court -6/29/15 - Felony domestic violence dismissed.  Presented DA with evidence of "victim" attacking and stalking my client.  Client had called the police on multiple occasions regarding victim.  DA dismissed upon reviewing evidence.

San Bernardino Court - 7/14/15 - Misdemeanor drug case dismissed. DA could not prove drugs were client's.

 Riverside Court 7/27/15 - Felony domestic violence case dismissed.  Police arrested both parties.  This is always a problem for the DA.

Rancho Cucamonga Court - 8/13/15- Felony domestic violence case dismissed. Victim lied to police.  We presented DA with statement from victim.  

Compton Court - 8/5/15 - Misdemeanor dui dismissed due to low levels.

Compton Court - 8/25/15 - Misdemeanor theft case dismissed by way of civil compromise.  

Long Beach Court 8/25/15 - Misdemeanor battery case dismissed.  Witnesses stated the case differently than the police report.  DA dropped charges.

Riverside Court- 9/2/15 - Misdemeanor domestic violence case dismissed.  Presented DA with witness account and the fact that client was trying to get his vehicle back from "victim" who stole his car.

December Results:


12/16/14 - Rancho Cucamonga Court - Misdemeanor hit and run case dismissed.  Was able to show that my client did actually stop and exchange information.  In fact, the "victim" gave the wrong insurance information, but we were able to get the claim handled regardless.  DA dismissed as a result.

12/16/14 - Rancho Cucamonga Court - Felony grand theft case.  Client was looking at 60 days of jail.  Was able to get NO JAIL by having client pay full restitution on case.

Domestic Violence Attorney Ty Martinez gets Felony Domestic Violence Cases Dismissed

November and December 2014 Case Results to date:


December 4, 2014 - Riverside Court - Misdemeanor domestic violence case dismissed.  

December 1, 2014 - Bellflower Court - Felony domestic violence case dismissed.  Victim was too intoxicated to accurately recall what happened, she also did not want prosecution. 

November 17, 2014 - Los Angeles Court - Felony domestic violence case dismissed. I was able to get DA to allow client to do couples counseling.  Upon showing progress DA dismissed case.


Criminal Defense Attorney Ty Martinez Gets Results

October 2014 Results-


10/13/14 -Riverside Court - 3 Felony counts of having unlawful sex with a minor. Went to trial and hung the jury - 10-2 in favor of NOT GUILTY.  Client was a substitute teacher, and young girl was 17 1/2 years old.  The law says if you actually and reasonably believe person was 18 then you are not guilty of the crime. Based on the fact that it was summer time, multiple statements made by young woman, and the fact she was a mature 17 1/2 year old.  Jury could not come to a decision.

10/17/14 - Rancho Cucamonga Court - Misdemeanor domestic violence case dismissed.  Client's ex girlfriend wanted to extort money from him.  "Victim" attempted to claim a bruise that was a week old, was the result of an altercation with my client an hour prior.  We provided DA with our expert's examination and opinion and got the case DISMISSED.

10/20/14 - Rancho Cucamonga Court - Misdemeanor drug possession case dismissed outright.  Case was 4 years old before deciding to prosecute! Prior to filing a speedy trial motion, I pointed out to DA crime lab destroyed evidence a couple of years back - case DISMISSED.

10/3/14 - Harbor Court Newport Beach - Misdemeanor possession of a deadly weapon - DISMISSED.

Los Angeles Criminal Defense Attorney Saves Client $16,000 in Restitution Payments

Los Angeles Court - Victim claimed $16,000.00 in damages from DUI involving accident.  Court ruled that victim was not credible on the stand and denied all of the $16,000.00 in restitution.

4/10/14 - Fontana Court - Felony Child Abuse case dismissed. We took case to trial.  Jury came back with NOT GUILTY on felony child abuse charges.  The jury was hung on the misdemeanor (7-5 in favor of not guilty).  Court had to declare a mistrial.  We went back to court and DA dismissed based on trial results.  Great work by Yvonne Todd who tried the case.

3/3/14 - Rancho Cucamonga Court - PC 242 Battery case dismissed outright.  Laid case out for District Attorney, pointed to fact that their "victim" was a defendant in another case where my client was the victim.  Other problems were demonstrated.  Case dismissed.

Long Beach DUI Attorney Ty Martinez Gets 20 Minute Not Guilty Verdict

2/20/14 - Long Beach Court - Client had a preliminary alcohol screening test on side of road with a result of .12, and a .08 chemical test back at the station.  Jury came back with a verdict of NOT GUILTY after only 20 minutes!

2/5/14 - Long Beach Court - Felony residential burglary case.  Client was an 18 year old who had never been in trouble before.  He was arrested before getting into home.  DA and two different judges wanted two years of state prison!  I kept pushing the case, got in front of the right judge who agreed it was not a state prison case and gave my client time served and sixty days of community service.

Downey DUI Attorney Ty Martinez Wins Restitution Hearing

1/14/14 - Downey Court - Client involved in felony DUI with injury.  Victims settled with insurance and then wanted an additional $22,000.00 from my client in restitution.  Settlement resolved for $7,000.00 saving my client $15,000.00.  Oddly enough victims are allowed to settle their cases with insurance and then go after people in criminal courts for legitimate losses.  The rationale is that the courts are not going to force victims to wait to get money from insurance if they need it.

Downey Domestic Violence Attorney Ty Martinez Gets Felony Domestic Violence Case Dismissed

1/3/14 - Downey Court - Felony Domestic case dismissed for plea to misdemeanor charge.  DA originally wanted 60 days of jail.  I was able to negotiate 10 days of work release.  Finally, over DA objection I was able to get the court to modify the no contact restraining order to allow contact.

10/ 25/13 - Van Nuys Court - .08 DUI dismissed due to rising blood alcohol argument.
